Competition and Consumer Protection Agency launch investigation against Pharmaceutical company

Tbilisi: The Competition and Consumer Protection Agency of the Republic of Georgia has launched a fresh investigation against the Pharmaceutical company. This investigation has been ordered by the Ministry of Health to ascertain the facts of alleged malpractices.

The agency has launched a nationwide drive against those who are responsible for anti-consumer practices. This time again, based on the guidelines of the Ministry of Health the Competition and Consumer Protection Agency has launched an investigation into another case against pharmaceutical companies.

It is to be specifically mentioned that this case concerns information published by the Ministry in December last year. According to that particular information pharmaceutical companies increased the price of medicines by 1000%, 2000% and 3000% compared to the price of imports in the last few years.

Similarly the competition agency is investigating about the possible abuse of the dominant position against eight pharmaceutical companies. The agency will also determine whether there was a right time for companies to fix unfair pricing or other unfair trading conditions.

It should also be noted that the Ministry of Health has already spread a mechanism of reference pricing for these medicines after which the price of the medicines decreased.

In recent years the National Competition Agency based on the guidance of the Ministry of Health completed another case investigation at the end of December. The study found that there was a serious breach of agreed action and violation of competition laws by pharmaceutical companies. 

In particular, “PSP Pharma”, “Avers”, “Pharmadepo”, “GPC” and “Mermis” set the same prices on oncological medicines with one white mark accuracy which is considered a great violation of consumer-related rights and practices.

The representative of the agency stated that the Competition Agency collected 52 797 934 GEL as a fine for violating the law. They also said that they would continue to fight against people or companies that violate consumers’ rights.
