Georgia: Based on the decision of the Strasbourg court, the special investigation service (SIS) detained a law enforcer on the fact of improper treatment.
Based on the re-investigation conducted by the Special Investigation Service and the decision of the European Court of Human Rights, on the fact of the inappropriate treatment of citizen Vladimir Mchedlishvili in the administrative building of the police, Inspector-Investigator of the Kakheti Police Department of the Ministry of Internal Affairs, Sighnaghi Regional Authority has been arrested.
According to the investigation of the case, it was determined that on May 15, 2017, in the city of Sighnaghi, near the marriage house, the victim Vladimir Mchedlishvili was drinking an alcoholic beverage with his companions. Employees of the Sighnaghi Regional Administration visited him at this time. One of the police officers – G. ნ. He called him to stop drinking alcoholic beverages in public spaces, followed by a negotiation between them.
Police officers arrested Mchedlishvili administratively and took him to the administrative building of Sighnaghi Police Administration, where inspector-investigator G. ნ. For several minutes, he was hitting the detainee’s fists and legs in the sides and head area and verbally insulting him. As a result of violence, the detainee was diagnosed with fractured ribs and suffered multiple other injuries.
Investigation of the incident started in 2017, parallel victim appealed to the European Court of Human Rights in Strasbourg to protect his rights, which made a decision on 14 December 2023 and found that victim Mchedlishvili is a violation of Article 3 of the European Convention on Human Rights (prohibition of torture / inhuman treatment). After this decision, Georgia has the obligation to conduct a re-investigation.
The special investigation service (SIS) handed over the case to 2024 and ensured a re-investigation. Within the framework of the renewed investigation, the service provided that, along with the evidence already obtained in the case, established new circumstances, for which the purpose of commissioning forensic and habitoscopic expertise, searched for self-evident witnesses and extracted documentation important to the case.
Accordingly, the rework of the investigation and the evidence obtained, based on the court’s order, the special investigative service (SIS) of the Ministry of Internal Affairs, inspector-investigator G. ნ. , who left the police lines in 2021, has been arrested for violating official authority.
The offense provided for by Article 333 of the Criminal Justice Code, “B” sub-clause provides for imprisonment from 5 to 8 years.
