A big relief for Vladimer Zaridze as court rules his dismissal unlawful

A city based court in Tbilisi has come to the rescue of Vladimir Zaridze as it announced his dismissal unlawful. The management of the country's national museum dismissed him from the services.

Tbilisi- A city based court has come to the rescue of Vladimir Zaridze as it announced his dismissal unlawful. The management of the country’s national museum dismissed him from the services.

 

The court’s decision came just two days ago. It ruled in favour of the former employee of the Tbilisi City Court. According to the court ruling the national museum illegally dismissed him from services.

The GYLA ( Georgian Young Lawyers Association ) which counseled on behalf of Zaridze stated that the court of Tbilisi overturned the Museum’s decision to terminate. Moreover in the same decision the court ordered the national museum to repay GEL 6,000 (1,987€) in compensation to the plaintiff.

 

It is to be added that the National Museum’s management dismissed Zaridze on June 1, 2022  more than two years ago. The employers cited the lack of required competencies as the main reason behind their decision to discontinue his services. On the other hand the court assessed that the employees’ competencies were not verified during or after the reorganization which is totally illegal and detrimental to career growth.

 

 

At the same time  the court’s presiding officer fully agreed with the plaintiff’s position in fact and in law. This dismissal case has underlined the mismanaged process of verifying the employee’s competence during the reorganization. It further underscores the lack of evaluation criteria and the refusal to offer the employee an equivalent vacant position which is necessary as per labour law. However refusal to give the due benefits to the employee is also a violation of the plaintiff’s rights under the labour law in the country.

 

 

Meanwhile as per the legal provisions the National Museum can appeal the decision in the higher court. The National Museum works under the Ministry of Culture. Tea Tsulukiani, the current minister of culture and sports is often accused by the opposition parties of politically motivated dismissals.
