Prosecutor court to appeal against order of Zestafoni regional court

Zestafoni: The Georgian prosecutor has decided to appeal against the Zestafoni regional court order. The court released an accused on bail.

It is to be specifically mentioned that the Prosecutor’s Office does not agree with the decision of Zestafoni Regional Court which granted bail to the accused for the persecution of his colleague. The office has approached the court to detain the accused as a measure of arrest.

It is to be added that an investigation in this regard was conducted by the Ministry of Internal Affairs. The initial investigation has established that in the period 2021 to 2023, in one of the villages of Terjoli municipality, a public school teacher systematically established unofficial and unwanted communication with his colleague.

It was also to be added that in particular the defendant insisted on sex with the victim, and despite the categorical refusal, he continued to try to approach her. The victim was forced to make a significant change in his lifestyle and take a long unpaid leave off work, which is a heinous crime as per the Georgian law.

After the initial investigation the school teacher was charged with the first part of Article 151 of the Criminal Code of Georgia (the pursuit that caused the victim’s mental suffering and fear of using violence).

The prosecutor’s office also addressed the Zestafoni district court to detain the accused as a measure of arrest for the accused along with a request for imprisonment and dismissal. However, the court released the accused on bail at a later stage.

The Prosecutor’s Office will appeal this decision to the Court of Appeal within the legal deadline. The office has decided to reverse the court’s order by appealing to a higher court.

On the other hand, in order to investigate the fact and take appropriate legal measures, the Prosecutor’s Office addresses the relevant resource centre of the Ministry of Education, Science and Youth of Georgia for further action.
