Tbilisi: The office of Public Defender of Georgia has resisted controversial amendments by Parliament. As per office most of the amendment have been done without taking public into confidence.
It is worth to note that Public Defender have taken to official Facebook book to inform public about this development as well. As per official Facebook page, “The public, the Parliament of Georgia has adopted significant legislative amendments over the past week, several of which, according to the Public Defender do not comply with human rights standards.”
It is noteworthy that despite the substantial nature of the legislative amendments, this legislative process was carried out in an expedited manner, without the involvement of the interested public or specialists in the relevant field which generally harms the legislative process and is not welcome.
At the same time official said that, as for the content of the legislative amendments the Parliament of Georgia discussed the amendments to be made to the Law of Georgia “On Public Service”.
Although the Legal Affairs Committee shared the opinions presented during the first hearing of the Public Defender of Georgia’s committee discussion regarding the grounds for reorganization.
it is regrettable that according to the finally adopted legislative draft, persons dismissed from the civil service due to reorganization will no longer have the right to request reinstatement in the civil service, which will put them in an unequal position with civil servants dismissed from service on other grounds.
It is to be added that new amendments were introduced during the second hearing, according to which the head of the primary structural unit and his deputy will no longer be considered professional civil servants, they will be appointed by administrative agreement, which significantly reduces the guarantees for the protection of labour rights of these persons.
It also contradicts the principles of the civil service rules also itself, such as career advancement, merit-based service and stability. At the same time these regulations will also apply to persons employed at a similar level in legal offices of public law of Georgia.
