At the government meeting held today, the draft of the resolution of the Government of Georgia initiated by the Ministry of Environment Protection and Agriculture “On the approval of the criteria for determining the remedial measures for significant damage by the person responsible for causing significant damage to the environment and the procedure for drawing up the plan for remedial measures for significant damage” was approved.
The draft is prepared on the basis of the Law of Georgia on “Environmental Responsibility” and defines the criteria for determining the remedial measures for the significant damage caused to the environment by the person responsible for causing significant damage to the environment and the procedure for drawing up the plan for the significant damage remedial measures.
According to the Law, the person responsible for causing significant damage to the environment is obliged to carry out remedial measures defined by the Law at his own expense and responsibility, according to the plan of remedial measures for significant damage agreed with the National Environment Agency.
Remedial measures for significant damage to the environment aim to restore damaged natural resources and services, in the following order:
- Restoration of damaged natural resources and/or service environment to its original state (prior to damage);
- Restoration of the damaged natural resources and/or service environment to a state close to its original (pre-damage) condition;
- Restoration of damaged natural resources and/or services by implementing replacement/adequate remedial measures in the vicinity of the damaged area or in “other territory”.
As a result of the acceptance of the project, the criteria for determining the remedial measures for significant damage by the person responsible for causing significant damage to the environment will be established, and the procedure for drawing up the plan for remedial measures for significant damage will be determined, which is important for the implementation of the requirements defined by the Georgian Law on “Environmental Responsibility”.
