Tbilisi: In a significant development, the constitutional court is all set to hear the lawsuit about abortion rights. The abortion rights of the victims of violence will be discussed in detail during a lawsuit filed by the public defender of Georgia.
It is worth noting that the lawsuit, which was filed by the office of the public defender of Georgia was finally accepted by the constitutional court of Georgia. The court will also decide what should be the legal age to give abortion rights to women who are victims of incidents of violence at any stage.
It is worth noting that the main subject of the case is a provision that covers the right to terminate a pregnancy between 12-22 weeks. This time will be counted after confirmation that women have been subjected to rape by criminals.
It is also to be noted that the office of the Public Defender in Georgia while commenting on the lawsuit, underlined that the existing legal provision causes multiple problems for the victim of violence. Moreover due to these multiple problems, we have decided to file this lawsuit.
As per current provisions of law, the time of court proceedings often exceeds the whole time of pregnancy, which then creates problems for the health of women as well. Moreover due to this problem it became impossible for many women to get the abortion done within the time limit. The lawsuit also mentioned clearly the provisions of article 140 of Georgia health law.
As per Article 140 of Georgian law about health protection, rape is defined as a ground of abortions. Moreover, as per equity laws women have to give full rights to decide about their rights. Notably the victim of sexual attacks is very vulnerable to violence. Victims of sexual violence are one of the most vulnerable groups so they need special attention and focus.
Any denial of abortion to women will cause emotional stress to women, so there is a need to reduce the time limit mentioned in the present laws. The official of the public defender office said they are expecting a positive outcome of the lawsuit in their favour.
