NGOs and CSOs blamed justice system for failure

The non-governmental organisation and civil society organisations have accused the justice system of Georgia for not fixing responsibility of erring officers.

Tbilisi: The non-governmental organisation and civil society organisations have accused the justice system of Georgia for not fixing responsibility of erring officers. They also demanded for fixing accountability of judicial system and judicial officers in a joint statement.

In the joint statement all the officials of these organisation added, “The monitoring report have exposed many disturbing facts. The reports underlined many incidents of psychological as well as physical abuses.”

As per the officials, this large scale violation of rules and regulation has happened due to  bias and a lack of accountability for law enforcement officials accused of violence, torture and inhuman treatment.

It is worth to note that report has further revealed there were almost 30 persons were arrested by law enforcement officials on charges of criminal act. Many of them alleged misuse of authority by law officers. However still not a single person has been arrested so far for exceeding their limit and using excessive force against the protesters.

It is also to be noted that all the protester detained are being prosecuted under various provisions of Georgian criminal law. The main provisions which have been imposed against them includes the 225 (participation in group violence), 187 (damage to property), 353 Prima (assault on police officers), 18-229 (preparation of an explosion), 156 (persecution), 260 (possession of drugs in large quantities) of the Criminal Code of Georgia.

All the provisions are very strict. In some charged accused can get a jail term between four to six years. Some offence can attract criminal penalty in form of 20 years jail term.

There are many names of judges which have been mentioned in report and are being suspected for bias approach adopted against detainees.  The judges namely Tamar Mchedlishvili, Irakli Khuskivadze, Davit Kurtanidze, Lela Maridashvili, Levan Kolbaia, Nana Shamatava and Davit Mgeliashvili are being blamed for acting under undue influence of ruling party of Georgia.

Civil society organisations at the same time called urged and immediate action against all those who are responsible for violence against protesters. They also demanded independent investigation in abuses and measure to stop this practice in future.
