Georgia: The Prosecutor’s Office of Georgia has filed charges against a doctor at the therapeutic department of the Academician Nikoloz Kipshidze Central University Clinic for improper treatment of a patient, which led to a worsening of his health condition.
An investigation conducted by the Ministry of Internal Affairs established that on August 11, 2021, a patient diagnosed with infection (COVID-19) caused by the new coronavirus (SARS-CoV-2) was admitted to the Academician Nikoloz Kipshidze Central University Clinic LLC, where he was treated.
The doctor at the therapeutic department of the aforementioned clinic, with whose direct involvement the treatment process was taking place, did not consider the relevant protocol for managing the patient’s clinical condition and prescribed medication to the patient without conducting the necessary research.
The treatment carried out in violation of the protocol worsened the patient’s health condition, which is why he was transferred to the intensive care unit, where he later died.
The prosecutor’s office of Georgia charged the defendant under Part 2 of Article 220 Prima of the Criminal Code (negligence, failure to perform or improper performance of his official duties by a person with special authority due to negligent attitude towards him, which led to serious consequences), which provides for a sentence of 2 to 5 years of imprisonment.
It is noteworthy that in the aforementioned criminal case, charges have also been brought against the head of the therapeutic department of the “Academician Nikoloz Kipshidze Central University Clinic” for improper treatment of the patient, which led to aggravation of his health condition, and the criminal case is being considered on the merits in the Tbilisi City Court. The Ministry of Internal Affairs of Georgia continues to investigate the criminal case.
